Recovery of Excess Salary
Subject : Employment Law
The Allahabad High Court has dismissed the state government's special appeal challenging a single bench order that quashed the recovery order from retirement benefits of an employee who received excess salary due to a departmental error. The court held that the excess payment was a result of the department's mistake and not the employee's fault, and therefore, recovery cannot be made.
