Himachal Pradesh High Court Restrains Chief Parliamentary Secretaries from Acting as Ministers

The High Court of Himachal Pradesh has issued an interim order restraining the six Chief Parliamentary Secretaries (CPS) appointed by the Congress government from functioning as ministers and availing ministerial amenities. The decision came in response to a petition filed by 12 BJP MLAs challenging the constitutionality of the CPS appointments. The court has prohibited the CPS from exercising ministerial duties and enjoying ministerial facilities, while allowing them to retain their positions. The case will be further heard on March 11, and the next hearing is scheduled for March 12. The appointment of CPS in Himachal Pradesh has been deemed unconstitutional, and the state government had previously defended the appointments, arguing that the CPS were acting within the law and not utilizing ministerial privileges. However, the court's interim order marks a significant development in the ongoing legal battle surrounding the role and entitlements of Chief Parliamentary Secretaries.
