Outraging Modesty of a Woman
Subject : Criminal Law - Domestic Violence
The Jammu & Kashmir High Court recently ruled that slapping a wife in public does not constitute an offence under Section 354 of the Indian Penal Code (IPC), which deals with outraging the modesty of a woman. The case involved a husband who was accused of slapping his wife in a public place. The husband challenged the issuance of process by the trial court on a complaint filed by his wife under Sections 354 and 323 of the IPC.The court observed that the act of slapping, in the absence of any sexual intent or motive, does not amount to outraging the modesty of a woman. The court further noted that the husband and wife had certain matrimonial disputes pending between them and that the incident occurred during a heated argument. The court's decision has sparked controversy, with some legal experts arguing that it sends the wrong message and undermines the protection of women from violence. Others have defended the decision, arguing that it is based on a narrow interpretation of Section 354 IPC and that the court was correct in considering the specific circumstances of the case.
