The Madras High Court has officially brought a close to the copyright infringement battle between legendary music composer Dr. Ilaiyaraaja and the production house Mythri Movie Makers. In a development that prioritizes amicable settlement over prolonged litigation, Justice Senthilkumar Ramamoorthy disposed of the matter after both parties reached a mutually agreeable compromise.
The legal conflict stemmed from the use of iconic musical tracks in the production company's films. Dr. Ilaiyaraaja had initiated the suit, C.S.(Comm.Div.) No. 299 of 2025, alleging that his copyrighted works—specifically the songs “Nooru Varusham” and “Karutha Machan”—were incorporated into the film "Dude" without proper authorization.
The plaintiff sought a permanent injunction to prevent the defendant from further exploiting these works, alongside a mandatory injunction for the take-down of infringing digital content and a request for the disclosure of profits generated from the unauthorized usage.
Under the guidance of the court, the parties entered into a joint memorandum of compromise dated November 28, 2025. The production company, Mythri Movie Makers, agreed to pay a total settlement sum of ₹50,00,000 (Fifty Lakhs), subject to a 10% Tax Deducted at Source (TDS).
This payment serves as a final resolution for the use of compositions in both "Dude" and another recent project, "Good Bad Ugly." Crucially, the agreement delineates the future rights: the production house maintains clearance to use the compositions within "Dude," while they have explicitly consented to desist from using any of Dr. Ilaiyaraaja's works in the upcoming film "Good Bad Ugly."
The court’s role was to ensure the legality of the private settlement. Upon review, Justice Senthilkumar Ramamoorthy found no legal impediments to the agreement, allowing the terms of the memorandum to become an integral part of the final decree. The ruling serves as a reminder of the efficacy of the Commercial Division’s mandate in resolving intellectual property disputes through negotiated settlements.
The decree stipulates that each party will bear their own costs, ending the matter effectively. For the film industry, this case serves as a clear blueprint for navigating copyright clearance and the importance of securing intellectual property rights well before the post-production or distribution stages. By formalizing their reach into a court-decreed settlement, both the composer and the production company have avoided the uncertainty of a trial, opting instead for a pragmatic business solution that respects the composer’s moral and economic rights while allowing the creative output of the film "Dude" to continue its run.
