Judges Cautioned Against Chauvinistic Language and Sermonizing: SC Judge Bhuyan Upholds Constitutional Morality

In a significant address at the South India Judges Regional Conference, Supreme Court Justices Abhay S Oka and Ujjal Bhuyan emphasized the importance of vigilance, fairness, and constitutional morality among judges at all levels. Justice Oka highlighted the need to realize the constitutional goals of delivering qualitative and effective justice promptly, urging judges to overcome challenges such as technological advancements alone cannot elevate the quality of judgments. Justice Bhuyan, emphasizing the judiciary's reliance on public faith, cautioned against eroding credibility through biased language or personal prejudices. He stressed the importance of deciding cases strictly in accordance with the law and upholding fairness and impartiality, urging judges to refrain from sermonizing and personal biases. Justice Oka further expressed concern over instances where accused individuals are compelled to approach the Supreme Court for bail despite the established principle that bail is a rule and jail is an exception. He emphasized the essence of Article 21 and the need for continuous training for judges to navigate the challenges of heightened public scrutiny facilitated by social media.
