The Supreme Court Collegium, responsible for recommending judicial appointments, had proposed Justice Bagchi 's name on March 6th. The Collegium's resolution highlighted several key factors that weighed in favor of his elevation. The resolution explicitly stated: "After the retirement of Mr. Justice Altamas Kabir on 18th July 2013 as Chief Justice of India, there has not been any Chief Justice of India from the High Court at Calcutta". This emphasizes the Collegium's intent to rectify the under-representation of the Calcutta High Court, a historical institution in the Indian judicial landscape. Currently, only one judge on the Supreme Court bench hails from the Calcutta High Court, further underscoring the need for increased representation.
However, Justice Bagchi ’s appointment has also ignited discussions surrounding the Collegium's selection process, particularly concerning the bypassing of several senior judges. While Justice Bagchi ’s competence and integrity are not under scrutiny, concerns have been raised as his elevation overlooks approximately ten senior judges, including eight Chief Justices of various High Courts. Justice Bagchi currently stands at the 11th position in all-India seniority among High Court judges. Notably, within the Calcutta High Court itself, there are four judges senior to Justice Bagchi who were bypassed. These include Justice Biswanath Somadder , Justice Indra Prasanna Mukerji , Justice Harish Tandon , and Justice Soumen Sen. Moreover, several other bypassed senior judges are currently serving as Chief Justices of different High Courts, positions traditionally considered a stepping stone to the Supreme Court.

Born in Calcutta on October 2, 1966, Justice Bagchi ’s legal journey began after graduating at the top of his LLB class from Calcutta University in 1991. He enrolled as an advocate in November 1991 and commenced his practice at the Calcutta High Court, specializing in both criminal and constitutional law. His expertise in these domains is well-recognized within the legal fraternity.

Justice Bagchi also served as an empanelled advocate for both the Central Government and the West Bengal state government, indicating the breadth of his legal practice and the trust placed in him by various governmental bodies. He represented several prominent public authorities, including the Kolkata Municipal Corporation, the Kolkata Port Trust, and the Calcutta Electric Supply Corporation.
Beyond his active legal practice, Justice Bagchi has shown an inclination towards academia. He served as a part-time lecturer at the University of Calcutta’s law department and the Jogesh Chandra Choudhary College of Law, contributing to legal education and shaping future generations of lawyers. He has also authored several articles in law journals, further demonstrating his scholarly pursuits and engagement with legal discourse.
Justice Bagchi 's judicial career commenced with his appointment as a judge of the Calcutta High Court on June 27, 2011. He served there for nearly a decade before being briefly transferred to the Andhra Pradesh High Court on January 4, 2021. His stint in Andhra Pradesh was short-lived, as he was transferred back to the Calcutta High Court on November 8 of the same year, where he has continued to serve until his present elevation to the Supreme Court.
Justice Bagchi ’s appointment will bring the Supreme Court closer to its full sanctioned strength of 34 judges, with the current count reaching 33. This increased judicial strength is crucial for effectively managing the substantial caseload before the apex court and ensuring timely dispensation of justice.
Furthermore, Justice Bagchi 's anticipated tenure as CJI, albeit short, carries symbolic significance.
