Kerala Co-op Bank Granted Installment Repayment Plan to Defaulting Borrower
Background:
A borrower, who had availed a loan from the Kerala Co-operative Societies Act, 1969, defaulted on their payments. The bank initiated proceedings against the borrower under the provisions of the Act, prompting the borrower to approach the Kerala High Court by filing a writ petition.
Legal Question:
Whether the court could grant the borrower an installment repayment plan to clear their outstanding liability.
Arguments Presented:
Court's Analysis and Reasoning:
The court took into consideration the submissions of both parties and observed that the borrower should be given an opportunity to repay the outstanding amount in a manageable manner.
Decision:
The court directed the bank to accept repayment of the entire amount of Rs. 7,77,072/- along with bank charges from the borrower in twelve (12) equated monthly installments, starting from 15-03-2024. The court also directed that in the event of default of any one installment, the bank would be entitled to proceed in accordance with the law. Additionally, all coercive proceedings against the borrower were ordered to be kept in abeyance to enable the borrower to repay the entire amount.
Significance:
This decision highlights the court's willingness to consider installment repayment plans for borrowers who are facing financial difficulties and are unable to repay their loans in a lump sum. It also emphasizes the importance of banks and financial institutions working with borrowers to find mutually agreeable solutions to avoid legal disputes.
