In a recent order that balances the administration of justice with procedural ethics, the Kerala High Court has granted bail to a municipal official accused of corruption, while simultaneously establishing a strict new directive to curb the practice of "judge-shopping" and the suppression of pending legal proceedings.
The petitioner, Lalachan V.M., then serving as a Superintendent at the Kochi Corporation’s Edappally Zonal Office, was arrested in October 2025 in connection with a Vigilance and Anti-Corruption Bureau (VACB) probe. The allegations center on a conspiracy between the petitioner and a Revenue Inspector to demand illegal gratification from a citizen, Smt. Darsha, in exchange for processing an online house ownership transfer application. Following a trap operation, the accused were taken into custody.
While defending the petitioner's plea for regular bail, the Court encountered a troubling discrepancy. Counsel for the petitioner had failed to disclose that an identical bail application was concurrently pending before the Special Court. By filing in both jurisdictions simultaneously, the accused engaged in what Justice A. Badharudeen described as an "experimental manner" of litigation, designed to secure favorable outcomes by withholding information from the higher court.
Justice A. Badharudeen’s ruling highlights the ethical duty of transparency in bail applications. The court emphasized that the suppression of facts regarding parallel proceedings is intrinsically dishonest and risks complicating judicial efficiency. To prevent this, the Court issued a mandatory instruction to the Registry:
> "The Registry of this Court is directed to verify all bail applications filed before this Court to ensure that there will be an undertaking in all the bail applications filed, stating that 'no other bail application/applications filed or pending in any other Courts in the District Judiciary as on the date of filing of the bail application before this Court'."
The ruling asserts that while the accused’s tactical errors could justify a summary dismissal, the Court opted to prioritize the progress of the investigation and the defendant’s period in custody since mid-October.
Ultimately, the Court allowed the bail application, subject to stringent conditions, including the execution of a ₹50,000 bond, the provision of two solvent sureties, and a restriction prohibiting the petitioner from entering the limits of the Kochi Corporation until the investigation concludes.
This judgment serves as a stern warning to legal practitioners and litigants alike: the High Court will not tolerate procedural manipulation. By mandating a formal declaration of status in all future bail filings, the Kerala High Court has reinforced the sanctity of the courtroom, ensuring that the privilege of bail is sought with integrity, not through strategic ambiguity.
