In a sharp rebuke to academic institutional management, the Kerala High Court has ruled that a university cannot cite financial hardship as a ground to withhold mandatory fellowships for PhD scholars while continuing to maintain its own administrative salaries.

The judgment, delivered by Justice D.K. Singh on May 27, 2025, underscores a vital principle: administrative overheads and senior leadership compensation cannot take precedence over the lawful financial entitlements of research students.

The Backdrop of the Dispute

The petitioner, Adarsh E., a PhD student at the Sree Sankaracharya University of Sanskrit, Kalady, faced an uphill struggle when he stopped receiving his sanctioned fellowship funds. Despite the university formally sanctioning the fellowship in August 2024, the promised financial support failed to materialize.

For months, the petitioner remained in the dark, eventually prompting him to approach the High Court seeking the disbursement of his legitimate dues.

The University’s 'Financial Crunch' Argument

Representing the Sree Sankaracharya University, the learned counsel attempted to justify the non-payment by citing a systemic "financial crunch" plaguing the institution. The university argued that its limited resources rendered it unable to prioritize the fellowship payments at the time.

However, this argument failed to survive the court's scrutiny.

A Scathing Legal Analysis

Justice D.K. Singh made short work of the university's defense, labeling the justification as unconvincing. The Court highlighted a fundamental contradiction: if the university possesses the liquidity to ensure the consistent, regular payment of the Vice Chancellor’s salary, there is no structural reason why it cannot afford to clear the fellowship arrears of a research scholar.

Furthermore, the Court noted that the State Government had recently sanctioned over Rs. 2.62 crore to the institution—a fact that effectively debunked the university’s narrative of a justifiable, unmanageable financial crisis.

Key Observations from the Court

The judgment captures the Court’s frustration with the institution's fiscal management and its disregard for the needs of its scholars:

  • "This Court is least impressed by the brilliant argument of the learned Counsel for the respondent University."
  • "If the Vice Chancellor of the University is being paid salary regularly, there can be no justification for non-payment of the petitioner’s fellowship."
  • "The Government has sanctioned Rs.2,62,56,000/- to the University which further indicates that the financial crisis does not appear to be justified."

Final Decision: The "Salary-First" Contingency

The Kerala High Court has granted clear, time-bound relief to the petitioner. The university is now under a direct mandate to pay the research fellowship regularly and clear all outstanding arrears within one month.

In a move to ensure compliance, the Court issued a stringent rider: if the fellowship amounts—including arrears—are not disbursed to the petitioner within the designated timeframe, the salary payments for both the Vice Chancellor and the Registrar of the university are to be suspended until the student's dues are settled. This judgment serves as a stern reminder that institutional accountability begins from the top, and that the financial rights of researchers are not discretionary assets to be sacrificed during administrative mismanagement.
