In a sharp rebuke to administrative inertia, the High Court of Kerala has ruled that a university cannot cite "financial crunch" as a justification to withhold research fellowships while continuing to pay its upper-tier management. The judgment, delivered by Justice D. K. Singh, serves as a significant precedent for research scholars struggling to secure their promised stipends.

The Conflict: Promises Kept in Paper, Not in Pocket

The petitioner, Adarsh E, a Ph.D. candidate at the Sree Sankaracharya University of Sanskrit, found himself in a state of academic limbo. Despite being formally sanctioned for a research fellowship in August 2024, the promised funds remained unpaid. Months later, facing financial uncertainty, the scholar approached the High Court, seeking judicial intervention to compel the disbursement of his arrears.

The Defense: A Financial "Crunch"?

During the proceedings, the University defended its failure to pay by pointing to a precarious financial situation. The counsel for the institution argued that a systemic cash shortage prevented the timely release of the fellowship amounts. However, this argument failed to sway the bench, which scrutinized the university's internal spending priorities with notable skepticism.

Judicial Scrutiny: If the Top Stays Paid, the Bottom Must Be Supported

Justice D. K. Singh dismantled the University’s plea with a logic that balances administrative accountability with the welfare of students. The Court noted a glaring inconsistency: while the institution claimed to be in distress, it had no difficulty in ensuring the routine salary payment for its Vice Chancellor. The Court further noted that a government sanction of over Rs. 2.6 crore undermined the validity of the "financial crisis" narrative.

Key Observations

The Court was unsparing in its assessment of the university’s managerial choices:

  • "This Court is least impressed by the brilliant argument of the learned Counsel for the respondent University."
  • "If the Vice Chancellor of the University is being paid salary regularly, there can be no justification for non-payment of the petitioner’s fellowship."
  • "Moreover, the Government has sanctioned Rs.2,62,56,000/- to the University which further indicates that the financial crisis does not appear to be justified."

The Verdict: A Deadline for Payment

Allowing the writ petition, the High Court issued a stern mandate: the respondents must clear the fellowship arrears within one month. The order includes a unique modus operandi to ensure compliance: the Court stipulated that if the dues are not paid in full by the deadline, the salaries of both the Vice Chancellor and the Registrar are to be withheld until the scholar receives his rightful funds.

This ruling sends a clear signal to higher education institutions: the financial welfare of students, particularly researchers, cannot be sacrificed to preserve administrative convenience during alleged budgetary constraints. It establishes an implicit rule of fairness, ensuring that those at the helm of academic institutions are held accountable for the basic financial obligations owed to their researchers.
