Kerala High Court Orders Accused in Financial Fraud Case to Surrender, Directs Trial Court to Consider Bail Application

Ernakulam, Kerala - December 12, 2024 - The Kerala High Court today disposed of a bail application filed by Smita Manoj , accused in a financial fraud case registered at Nenmara Police Station, Palakkad. While Justice P.V.Kunhikrishnan declined to grant bail under Section 482 of the Bharatiya Nagarik Suraksha Sanhita (BNSS), the court directed the petitioner to surrender before the Investigating Officer and further instructed the jurisdictional court to consider her bail application on the day of her production.

Case Background

The case, Crime No. 744/2024, was registered at Nenmara Police Station based on a complaint filed by the Managing Director of SAAF Capit Federation. Smita Manoj is accused of offences punishable under Sections 408 (Criminal breach of trust by clerk or servant), 468 (Forgery for purpose of cheating), and 420 (Cheating and dishonestly inducing delivery of property) of the Indian Penal Code (IPC), 1860.

The prosecution alleges that Ms. Manoj , while working for SAAF Capit Federation, collected substantial amounts from customers but issued forged receipts, failing to deposit the funds with the company.

Court Proceedings and Decision

Advocates Rizwana A.A. and Aqib Sohail P.S. represented the petitioner, while Senior Public Prosecutor C.B. Jithin appeared for the State. Advocate Abraham Mathan C.B. represented the additional respondent, Jishnu Thankappan.

The Public Prosecutor vehemently opposed the bail application. Justice Kunhikrishnan , after hearing both sides, stated, "After hearing both sides, I think this is not a fit case, in which orders u/s. 482 BNSS can be passed."

However, considering the submission from the petitioner's counsel that Ms. Manoj was willing to surrender, the Court disposed of the bail application with specific directions to ensure a smooth process for both investigation and consideration of bail.

Key Directions by the Court

The High Court issued the following directives:

Surrender: Ms. Smita Manoj must surrender before the Investigating Officer within two weeks from December 12, 2024.

Production Before Court: Upon surrender, the Investigating Officer is mandated to interrogate Ms. Manoj and produce her before the jurisdictional court on the same day.

Bail Application Consideration: Ms. Manoj is permitted to file a bail application before the jurisdictional court at the time of her production. The court is instructed to consider this bail application "in accordance with law and pass appropriate orders in it preferably on the date of filing itself," provided an advance copy is given to the prosecutor.

Custody Application: The Investigating Officer retains the liberty to file a custody application, should it be deemed necessary. The jurisdictional court is empowered to pass appropriate orders on such an application as well.
