judgement
Subject : Administrative Law - Local Government
In a recent judgement, the Kerala High Court dismissed a writ petition challenging an order by the Tribunal for Local Self Government Institutions, Thiruvananthapuram, which had set aside a Panchayath order rejecting an application for a building permit. The Tribunal had directed the Panchayath to issue a permit to the appellant within 30 days. The petitioner argued that the Tribunal's order was illegal and arbitrary, and that the Panchayath had rightly rejected the application due to violations of building regulations. However, the High Court found no merit in the petitioner's arguments and held that the Tribunal had acted within its jurisdiction and had not committed any errors of law. The Court also noted that the writ petition had been pending for several years without any interim orders being passed, and that service to the second respondent had not been completed. Accordingly, the Court dismissed the petition.
