The petitioner argued that the allegations were baseless, maintaining that no such ESOP scheme was active during the relevant period and that share allotments were strictly board-decisions, nullifying his individual liability. While acknowledging that purchasing property as benami may fall outside the shield of Section 17A, the court maintained that procedural compliance remains non-negotiable for the Vigilance and Anti-Corruption Bureau (VACB).
