In a procedural development at the Madurai Bench of the Madras High Court, the court has opted to close a contempt petition filed against officials of the Tamil Nadu State Transport Corporation (TNSTC), citing the existence of a parallel appellate proceeding.

The Genesis of the Dispute

The matter originated from a previous order passed by the High Court on August 10, 2023, in W.P.(MD).No.19399 of 2023 . The petitioner, K. Balakrishnan, had initiated contempt proceedings under Section 11 of the Contempt of Courts Act, 1971, alleging willful disobedience and non-compliance with the court’s earlier directions by the Managing Director, General Manager, and Chief Financial Officer of TNSTC (Kumbakonam), as well as the Administrator of the Employees Pension Fund Trust.

The Judicial Stance

When the matter came before the Honourable Mrs. Justice L. Victoria Gowri on February 4, 2026, the respondents’ legal counsel informed the court that the original order of August 2023 had been challenged. Specifically, the transport corporation had preferred a Writ Appeal, W.A(MD).No.2247 of 2025 , in which an interim stay had already been granted by the appellate bench.

Given that the underlying order is currently subject to an interim stay, the court determined that the contempt petition could not proceed at this juncture.

The court’s order reflects a cautious approach to judicial hierarchy and the finality of orders:

  • "When the matter came up for hearing, the learned Standing Counsel submitted that as against the order of this Court in WP(MD).No.19399 of 2023, writ appeal in W.A(MD).No.2247 of 2025 has been preferred, in which, an order of interim stay was granted."
