CHENNAI: The Madurai Bench of the Madras High Court has lauded the Tamil Nadu government for its "commendable" and "proactive" measures in strengthening the framework against workplace sexual harassment. In a significant order dated November 19, 2025, Dr. Justice R.N. Manjula disposed of three writ petitions after recording the extensive compliance by the state with a series of sweeping directions aimed at fostering gender sensitivity and ensuring the effective implementation of the Sexual Harassment of Women at Workplace (Prevention, Prohibition and Redressal) Act, 2013 (PoSH Act).
The court praised the state's efforts, noting that the "novel and result-oriented" steps could serve as a "model for the other States to follow."
The matter originated from three separate writ petitions filed by Dr. Supraja, Dr. Resmi M Nair, and L.C. Vanitha. However, the case evolved beyond the individual prayers into a broader examination of the state's machinery for preventing sexual harassment. In a detailed order on November 21, 2024, the court had issued a comprehensive set of directions aimed at tackling the issue at its socio-cultural roots.
These directives included calls for the state to frame rules under the PoSH Act, create a public dashboard for Internal Committees (ICs), and report on the feasibility of radical reforms such as: - Including gender sensitization questions in competitive recruitment exams. - Making a gender sensitivity test mandatory for promotions and increments. - Forming "Gender Sensitivity Audit Squads" to inspect workplaces. - Mandating a "gender sensitivity clearance certificate" for obtaining various licenses. - Developing age-appropriate sexual education for students.
In response, the Tamil Nadu government submitted a detailed status report showcasing significant progress, which formed the basis of the court's final order. Key actions taken by the state include:

Dr. Justice R.N. Manjula expressed profound appreciation for the collaborative efforts of all stakeholders. The judgment noted, "The overall response and interest shown by the State Government in implementing the directions is no doubt commendable." The court specifically praised the Social Welfare Department, the State Women Commission for its assistance with draft rules, and the state's law officers.
While acknowledging the state's preference for a "persuasive approach" over a "coercive" one, the court added a word of caution: "If the desired outcome is not achieved and the process is not adequate, there need not be any hesitation to take a shift from convincing efforts and compulsive actions."
The court also took a moment to appreciate the petitioners "for the courage and the public spirit" they showed by consenting to have their names used in the orders without redaction.
Finding that the state had demonstrated a clear commitment to realizing the objectives of the PoSH Act, the High Court disposed of all three writ petitions, directing the Chief Secretary to circulate the order to all concerned departments for continued action.
