Madras HC Lauds TN Govt's 'Commendable' Steps to Strengthen PoSH Act; Disposes of Petitions After Reviewing Compliance on Gender Sensitization Measures

Madras High Court Applauds Tamil Nadu's Proactive Overhaul of PoSH Act Implementation

CHENNAI: The Madurai Bench of the Madras High Court has lauded the Tamil Nadu government for its "commendable" and "proactive" measures in strengthening the framework against workplace sexual harassment. In a significant order dated November 19, 2025, Dr. Justice R.N. Manjula disposed of three writ petitions after recording the extensive compliance by the state with a series of sweeping directions aimed at fostering gender sensitivity and ensuring the effective implementation of the Sexual Harassment of Women at Workplace (Prevention, Prohibition and Redressal) Act, 2013 (PoSH Act).

The court praised the state's efforts, noting that the "novel and result-oriented" steps could serve as a "model for the other States to follow."

From Individual Grievances to Systemic Reform

The matter originated from three separate writ petitions filed by Dr. Supraja, Dr. Resmi M Nair, and L.C. Vanitha. However, the case evolved beyond the individual prayers into a broader examination of the state's machinery for preventing sexual harassment. In a detailed order on November 21, 2024, the court had issued a comprehensive set of directions aimed at tackling the issue at its socio-cultural roots.

These directives included calls for the state to frame rules under the PoSH Act, create a public dashboard for Internal Committees (ICs), and report on the feasibility of radical reforms such as: - Including gender sensitization questions in competitive recruitment exams. - Making a gender sensitivity test mandatory for promotions and increments. - Forming "Gender Sensitivity Audit Squads" to inspect workplaces. - Mandating a "gender sensitivity clearance certificate" for obtaining various licenses. - Developing age-appropriate sexual education for students.

State Government's Comprehensive Compliance Report

In response, the Tamil Nadu government submitted a detailed status report showcasing significant progress, which formed the basis of the court's final order. Key actions taken by the state include:

  • Policy and Transparency:

    • Issued an exhaustive Standard Operating Procedure (SOP) in lieu of rules, which the state claimed it had limited power to frame.
    • Launched a TN POSH Portal , uploading details of over 41,103 Internal Committees from both government (22,044) and private (34,907) establishments to ensure transparency.
    • Designated 2,981 Nodal Officers at block, taluk, and tehsil levels to oversee PoSH compliance.
  • Recruitment and Promotion Reforms:

    • The Tamil Nadu Public Service Commission (TNPSC) , Uniformed Services Recruitment Board (TNUSRB), Medical Recruitment Board (MRB), and Teacher Recruitment Board (TRB) have all revised their syllabi to include questions on gender sensitization in future examinations.
    • The PoSH Act has been included in the syllabus for the departmental office manual test , a prerequisite for promotions for government servants.
  • Enforcement and Education:

    • A Government Order has been issued to form Gender Sensitivity Audit Squads to inspect workplaces and assess employee behavior.
    • A curriculum committee is developing a comprehensive module for Higher Educational Institutions on sexual health, consent, and gender inclusivity .
    • Guidelines for child safety under the POCSO Act have been reinforced in schools, with measures like Student Safeguarding Advisory Committees and a toll-free complaint number (14417).

Court's Observations and Final Decision

Dr. Justice R.N. Manjula expressed profound appreciation for the collaborative efforts of all stakeholders. The judgment noted, "The overall response and interest shown by the State Government in implementing the directions is no doubt commendable." The court specifically praised the Social Welfare Department, the State Women Commission for its assistance with draft rules, and the state's law officers.

While acknowledging the state's preference for a "persuasive approach" over a "coercive" one, the court added a word of caution: "If the desired outcome is not achieved and the process is not adequate, there need not be any hesitation to take a shift from convincing efforts and compulsive actions."

The court also took a moment to appreciate the petitioners "for the courage and the public spirit" they showed by consenting to have their names used in the orders without redaction.

Finding that the state had demonstrated a clear commitment to realizing the objectives of the PoSH Act, the High Court disposed of all three writ petitions, directing the Chief Secretary to circulate the order to all concerned departments for continued action.
