Legal Roadblock: Madras High Court Stalls 'Drishyam 3' Digital Debut

In a significant development for Intellectual Property (IP) enforcement within the film industry, the Madras High Court has issued an interim injunction restraining the makers of the thriller film Drishyam 3 from releasing its Telugu-dubbed version on OTT platforms. This high-stakes dispute centers on the exclusive rights to exploit the film's remake and dubbing versions in the Telugu language, pitting a major production house against the film's original creators.

The Backdrop of the Dispute The legal challenge was initiated by M/s. Rajkumar Theatres Pvt Ltd , which asserted its exclusive copyright to the Telugu remake and exploitation rights of the Mohanlal-starrer Drishyam 3 . The firm turned to the High Court seeking an urgent intervention to prevent the respondents—Aashirvad Cinemas, Mr. Jeethu Joseph, Panorama Studio, and Pen Studios—from proceeding with the digital release of the Telugu dubbed version.

The applicant's case, presented by Senior Advocate Mr. K. Ravi, argued that the unauthorized release of the Telugu version in the international OTT space would constitute a direct infringement of their contractual and proprietary rights.

A One-Sided Legal Battle Despite the urgency of the matter and the proper service of private notices, the respondents failed to appear before the court. The lack of representation was noted by the bench with severity, particularly as the film’s scheduled digital debut on June 18 was rapidly approaching. This non-appearance cleared the path for the court to grant immediate protective measures pending the resolution of the main suit.

Court Observations The bench presided over by Justice K. Kumaresh Babu focused on the preservation of the applicant's copyright until the legal arguments could be fully heard. The court explicitly noted:

“It is to be noted that, in spite of service of private notice on them, none of the respondents has entered appearance or is present before this Court. Their names have also printed in the cause list.”

The court further formalised the restriction, stating:

“In such view of the matter, there shall be an order of interim injunction, restraining the Respondents/Defendants... from exploiting the copyrights of the applicant by releasing the same in the OTT Platform.”

Practical Implications and The "Streaming Twist" The interim injunction serves as a critical checkpoint for film production agreements, emphasizing that the chain of title for remake rights must be strictly observed during digital distribution. While the court's order aims to protect the petitioner's business interests, the situation remains fluid.

Reports following the order indicate an unexpected turn of events: despite the injunction, the Telugu version became available on Amazon Prime Video. This development underscores the complexities of modern digital distribution, where global automated releases may collide with territorial legal constraints.

Moving Forward This standoff highlights an increasing trend of copyright disputes hitting the higher judiciary just days before major digital premieres. For production houses, the message from the Madras High Court is clear: the failure to settle distribution rights or secure clear clearances can lead to last-minute legal hurdles that threaten the integrity of a multi-million-dollar digital launch. While the legal battle over the Telugu rights continues, the incident serves as a cautionary tale for distributors and platforms regarding the necessity of definitive rights documentation.
