Copyright Infringement
Subject : Civil Law - Intellectual Property Rights
In a proactive resolution to a burgeoning intellectual property dispute, the Madras High Court has formally closed the copyright infringement suit filed by RS Infotainment against Mini Studio LLP and Disney Star (Hotstar) . The matter, which centered on the unauthorized use of creative assets from the acclaimed film Vinnaithandi Varuvaya (VTV), concluded after the parties reached a settlement involving the sensitive modification of digital content.
The plaintiff, RS Infotainment , initiated the legal action under the Copyright Act, 1957 , alleging that their protected cinematic work—specifically scenes and background scores—was being utilized without authorization in the film Aaromaley . The legal battle sought a permanent injunction to halt the exhibition of the allegedly infringing material across digital and OTT platforms, most notably the Disney Hotstar service.
The litigation gained momentum under Justice Senthilkumar Ramamoorthy . However, rather than heading for trial, the parties engaged in out-of-court negotiations. This resulted in a collaborative effort where the first defendant, Mini Studio LLP , agreed to excise or modify the contested content.
On November 26, 2025, RS Infotainment reviewed the modifications and, finding them satisfactory, expressed that they no longer had any objections to the broadcasting or distribution of the now-altered film.
The High Court emphasized the importance of party-driven settlements in commercial disputes. In his order, Justice Senthilkumar Ramamoorthy noted:
The Court officially decreed the suit in terms of the Joint Memorandum of Settlement dated December 5, 2025. Effectively, the settlement agreement has become an integral part of the court's final decree. Consequently, the High Court directed that there shall be no order as to costs, and all pending applications related to the suit have been closed.
This outcome highlights a practical approach to modern digital disputes, where immediate content modification serves as a viable alternative to prolonged litigation, ensuring that both the rights-holder’s intellectual property is protected and the defendant’s platform distribution can continue without prejudice.
