The High Court of Judicature at Madras recently presided over the resolution of a long-standing industrial dispute involving Cognizant Technology Solutions India Private Limited and its former employee, R. Senthil Kumar. A division bench comprising Justice J. Nisha Banu and Justice M. Jothiraman formally closed the litigation after the parties reached an amicable settlement, bringing a definitive end to their employer-employee relationship.

A Long Road to Resolution

The dispute originated from the termination of R. Senthil Kumar’s employment on February 25, 2019. The matter proceeded through the Labour Court, which eventually issued an award. This was followed by cross-writ petitions, resulting in a common order that modified the initial award to reinstate the worker without back wages, but with full continuity of service. The current proceedings, Writ Appeal No. 3694 of 2024, emerged from the management's challenge to that order.

Terms of the Mutual Accord

Recognizing the benefit of avoiding further litigation, both parties opted for a negotiated settlement dated July 31, 2025. The core terms of the agreement include: * Finality of Termination: The respondent has accepted the 2019 termination order as final and irrevocable. * Financial Settlement: Cognizant has agreed to pay a lump sum of ₹27,50,000, subject to applicable tax deductions, in full and final settlement of all past and pending claims. * Release of Liability: The worker has waived all rights to future claims, including demands for reinstatement or further financial compensation related to the previous Labour Court awards and subsequent writ orders. * Mutual Non-Disparagement: Both parties have committed to maintaining the confidentiality of the settlement and agreed to avoid any disparaging comments against each other.
