Madras High Court Condemns Exploitation of Junior Lawyers by Senior Lawyers
In a significant ruling, the Madras High Court has addressed the pressing issue of non-payment of junior lawyers by their senior counterparts, terming it as exploitation and a violation of fundamental rights.
The primary issue was the non-implementation of The Advocates' Welfare Fund Act, 2001, in Puducherry, which deprived lawyers of their rightful benefits. However, the court also addressed the broader issue of senior lawyers not paying junior lawyers, which was brought to light during the proceedings.
The court noted that around 200 applications seeking benefits under the Tamil Nadu Advocate's Welfare Fund were pending. The court emphasized that lawyers practicing in Puducherry, who are also enrolled in the Bar Council of Tamil Nadu and Puducherry, should not face discrimination, and the benefits under the welfare scheme should be uniformly available to all eligible members.
The court strongly condemned the practice of senior lawyers not paying junior lawyers, describing it as exploitation and a violation of fundamental rights. The court stated, "Extracting work without payment is an exploitation and directly in violation of the fundamental rights enshrined under the Constitution."
The court highlighted the responsibilities of the State Bar Councils under Section 6 of the Advocates Act, 1961, which includes safeguarding the rights, privileges, and interests of advocates. The court urged the Bar Council to ensure that a minimum stipend is paid to junior lawyers by those engaging their services.
The court directed the Bar Council to frame guidelines to ensure the payment of a minimum stipend to junior lawyers, thereby protecting their livelihood and encouraging their professional growth. Justice S.M. Subramaniam , delivering the order, remarked, "The livelihood of these young brilliant lawyers, who have started their practice with a fond hope, must be encouraged by the senior lawyers, legal fraternity, and the Courts." The court further noted, "Exploitation at no circumstances can be permitted nor be appreciated."
