Representing the State of Tamil Nadu, the Government Advocate (Criminal Side) provided a definitive stance. It was submitted that there is currently no case pending against the petitioner and that the respondent police are not engaging in any harassment. This submission effectively became the cornerstone of the Court's decision, neutralizing the necessity for further judicial intervention in this specific instance.
The judgment clarifies the court’s role in balancing citizen rights with law enforcement responsibilities. Reflecting on the government’s submission, the court recorded the following in its official order:
> "The learned Government Advocate (Criminal Side) submitted that no case is pending against the petitioner as of now and the respondent Police are not harassing the petitioner."
The court further noted:
> "Recording the submission made by the learned Government Advocate (Criminal Side), this Criminal Original Petition stands closed."
The Madras High Court resolved the matter by formally closing the Criminal Original Petition. By recording the undertaking provided by the State, the court has essentially ensured that the police are bound by their submission on the record. While the petition did not lead to an expansive ruling on police reforms, the procedural closure serves as a reminder that the judicial system acts as a watchdog to ensure that police actions—particularly those not backed by an FIR or formal investigation—remain within the bounds of the law.
This decision reinforces the practice of utilizing judicial oversight to compel transparency from the State regarding whether an individual is truly under investigation, thereby preventing potential abuse of power in administrative or informal police actions.
