In a significant ruling addressing the boundaries of judicial authority, the High Court of Karnataka, presided over by Justice M. Nagaprasanna, has categorically barred Magistrate courts from interfering with the issuance or modification of Look Out Circulars (LOCs). The Court clarified that because LOCs are "executive edicts," only constitutional courts possess the power to scrutinize or rescind them.
The matter arose from two interconnected petitions involving a couple in a marital dispute. While the husband sought the recall of an LOC to resume his professional responsibilities as a United Kingdom citizen employed in Scotland, the wife filed a separate writ petition seeking strict action against the police and an investigation into the issuance of the LOC.
During the proceedings, it came to light that the husband had bypassed his ongoing writ petition and successfully moved a trial court to recall the LOC. The Magistrate, exceeding conventional jurisdictional limits, allowed the application and permitted the husband to travel abroad.
Justice Nagaprasanna expressed deep dissatisfaction with the Magistrate’s actions, noting that the trial court ventured "far beyond the pale of its authority" in attempting to adjudicate the validity of an executive order. The court observed that the Magistrate did not have the jurisdiction to entertain such an application, and that doing so creates a chaotic precedent.
"The LOC, as observed hereinabove, is an executive edict—administrative in its conception and effect, and therefore, beyond the ken of trial Courts to annul or tamper with," the court stated.

Amidst the complex legal arguments, the Court also took a moment to laud the efforts of Advocate Sarah Sunny, who represented the petitioner-wife. Despite being hearing and speech impaired, the advocate demonstrated that "true advocacy transcends barriers of sound." The Court praised her performance as an inspiration, stating that her submissions served as a testament to humanity's collective march towards equality and inclusivity within the legal profession.
The High Court has directed its Registry to circulate the order to all criminal courts across the State of Karnataka. The message is clear: trial courts are to restrict their focus to the adjudication of criminal cases before them and must not attempt to act as appellate authorities over executive decisions like LOCs.
By reinforcing this boundary, the judgment restores the standard procedure for challenging LOCs and warns against judicial overreach that could compromise the integrity of ongoing investigations. While the husband has already departed for Scotland, the legal precedent set here ensures that future efforts to undermine executive circulars through lower courts will be treated with "serious disapproval."
