O R D E R
For the reasons stated in the application (IA No.238869/2023) seeking restoration of Transfer Petition (C) No.1911 of 2023, the same is allowed.
Miscellaneous Application is disposed of.
The petition is restored to its original number, i.e., Transfer Petition (C) No.1911 of 2023. Following the restoration of the petition, interim order passed on 11.08.2023 in the Transfer Petition shall also stand restored and the Transfer Petition is taken up for hearing today itself.
Learned counsel appearing for the parties submitted that an effort should be made to have a mediated settlement.
Accordingly, to facilitate the parties to arrive at an amicable solution, the parties are referred to the Supreme Court Mediation Centre. The first appearance of the parties before the Supreme Court Mediation Centre shall be virtual appearance on 22.01.2024 at 11:00 a.m. Thereafter, the proceedings will be conducted either virtually or by physical presence as per the suggestion of the learned mediator.
We would request the Mediation Centre to expedite the proceedings and send the report at the earliest, preferably within six weeks from the date of appearance of the parties.
List the matter after the mediation report is received.
