The Meghalaya High Court has issued a judgment in the case of Smti Lemina K. Marak, a widow of a former non-teaching staff member of a District Council school in the state. The petitioner, Smti Lemina K. Marak, argued that her late husband was entitled to pension benefits as a non-teaching staff member of a District Council school that was taken over by the state government under the Meghalaya (Taking over of District Council Lower Primary Schools) Act, 1993. The state respondents acknowledged the receipt of the petitioner's representation and stated that they were trying to resolve the issue regarding the payment of pensionary benefits to the non-teaching staff, including the petitioner's late husband.
The Meghalaya High Court noted that this case was similar to other matters that had been brought before the court regarding the entitlement and payment of pension to non-teaching staff of District Council schools taken over by the state government. The court observed that in the earlier matters, the state respondents had provided the petitioners with their due pension entitlements.
The court also took note of the state respondents' affidavit, which stated that they were trying to resolve the issue of pension payments for the non-teaching staff, including the petitioner's late husband. The court found this to be a satisfactory response and decided to dispose of the matter.
The Meghalaya High Court directed the state respondents to expedite the process for consideration of the family pension to the petitioner, Smti Lemina K. Marak. The court expected the process to be completed within a period of four months from the date a copy of the order was presented to the state respondents.
