Subject: - Pension and Retirement Benefits
The MESEB Pensioners' Association, represented by its President Shri. Marius Kharkongor, filed a writ petition before the High Court of Meghalaya seeking the timely payment of retirement and pensionary benefits for retired employees of the Meghalaya Energy Corporation Limited (MeECL).
The petitioners argued that a substantial number of retired employees and pensioners of MeECL, who had retired as far back as 2015, were yet to receive their terminal benefits. Despite representations made to the authorities, the payments were being denied due to a lack of funds, according to the petitioners.
The respondents, including the State of Meghalaya and the Department of Finance, contended that the issue had already been addressed in a series of previous writ petitions, where the court had directed MeECL to clear the dues within a year.
The High Court noted that the grievances raised by the petitioners had already been adjudicated in a previous judgment, where the court had directed MeECL to endeavor to clear the dues of the retired employees within a year.
The court acknowledged the financial constraints faced by MeECL but emphasized the need to prioritize the timely payment of retirement benefits to the affected pensioners.
The High Court disposed of the present writ petition in terms of the previous order, directing MeECL to make every effort to clear the outstanding dues of the retired employees within one year from the date of the order. The court also allowed the petitioners to approach the court for any other issues related to the release of their retirement benefits.

Retired employees are entitled to timely payment of retirement benefits, and undue delay without justification is impermissible.
Pensions are statutory rights requiring prompt payment to retirees; administrative delays violate principles of justice and dignity.
The legal principle affirmed is the obligation of an employer to disburse retirement benefits, thus upholding the right of employees to timely remuneration despite financial constraints.
Retired officials cannot be held liable for actions taken after their employment period, reaffirming the need for due process in pension disbursements.
