In a recent order, the Madurai Bench of the Madras
The petitioners, including Kottaisamy and five others, had approached the High Court seeking the quashing of the final report in Special SC No. 205 of 2025. The case originated from a complaint filed at the All Women Police Station in Samayanallur, Madurai, involving allegations under various sections of the POCSO Act and the Indian Penal Code (IPC), specifically Sections 294(b), 323, and several provisions of the POCSO Act (Sections 7, 8, 16, 17, 9(n), 10, 11(1), and 12). The petitioners argued that they had been falsely implicated in the matter.
During the proceedings, the Additional Public Prosecutor representing the state vehemently opposed the quashing plea, pointing to the gravity of the sexual offences alleged against the petitioners. Upon reviewing the charge sheet, Justice Gowri determined that the allegations provided a clear basis for the criminal trial to proceed.
The court emphasized that where explicit allegations of sexual abuse against a child exist, the judicial threshold for quashing a charge sheet is high. In this instance, the court found no merit in the petitioners' request to terminate the proceedings before the Principal Special Court for Exclusive Trial of cases under the POCSO Act.
The court’s decision was characterized by a focus on both substantive legal principles and procedural ethics. Justice Gowri provided the following key observations:
> "On a careful reading of the charge sheet, it is evident that there is a clear allegation of having indulged in sexual activities against the victim."
> "In view of the seriousness of the allegations, this Court is not inclined to interfere with the same, and accordingly, this petition is liable to be dismissed."
> "That apart, this Court strongly condemns the conduct of the petitioners’ counsel for having mentioned the name of the victim as the second respondent."
Beyond the dismissal of the plea, the court found the conduct of the petitioners' counsel unacceptable for revealing the victim's identity in the court documents. Protecting the identity of a child victim is a foundational mandate under the POCSO Act. To address this breach of privacy, the High Court imposed a penalty of Rs. 25,000 on the petitioners, to be paid to the victim by February 12, 2026.
The order serves as a reminder to legal practitioners and litigants that courts will maintain a zero-tolerance policy regarding the disclosure of victim identities in sensitive cases. By rejecting the motion to quash and mandating financial restitution, the Madurai Bench has reinforced the sanctity of the POCSO Act’s privacy provisions, ensuring that the trial before the Special Court can proceed without further procedural delays regarding the identity of the survivor.
