MP High Court Grants Temporary Bail on Humanitarian Grounds to Murder Accused

INDORE: The High Court of Madhya Pradesh at Indore has granted temporary bail to an 18-year-old murder accused, enabling him to attend to his seriously ill father who requires urgent heart surgery. The court's decision, delivered on May 31, 2024, underscored the importance of humanitarian considerations, especially when the applicant had previously complied with bail conditions.

Case Background

The applicant, Irfan S/o Afzal , has been in judicial custody since June 4, 2021, in connection with serious charges including murder (Section 302 IPC), attempt to murder (Section 307 IPC), and wrongful confinement (Section 342 IPC), registered at Police Station Jiwajiganj, Ujjain. This was his third application for bail under Section 439 of the Code of Criminal Procedure (Cr.P.C.).

Arguments Before the Court

The counsel for the applicant, Shri Jitendra Sharma, did not press for regular bail. Instead, the plea was focused solely on securing temporary release on compassionate grounds. The central argument was the critical health of the applicant's father, who is suffering from severe heart ailments and needs immediate surgery. It was argued that any delay could be "fatal." To substantiate the claim, medical documents were submitted to the court.

The State, represented by Penal Lawyer Shri Anendra Singh Parihar, verified the authenticity of the medical documents, confirming the gravity of the father's condition.

Hon'ble Shri Justice PranayVerma , while considering the plea, highlighted two key factors in his order.

First, the court acknowledged the verified and serious medical condition of the applicant's father.

Second, and crucially, the court noted the applicant's past conduct. A pivotal point in the judgment was the reference to a previous order dated May 10, 2023, where Irfan had been granted temporary bail and had not misused his liberty.

In a key excerpt from the order, Justice Verma stated:

"...in view of medical condition of father of the applicant and also for the fact that applicant did not misuse the liberty of temporary bail granted to him earlier... I deem it fit to grant temporary bail to the applicant for a period of three weeks from the date of his release."

Final Order and Implications

The High Court allowed the miscellaneous criminal case, directing the temporary release of the applicant for a period of three weeks. The release is subject to furnishing a personal bond of ₹50,000 with one solvent surety.

The court has strictly mandated that the applicant must surrender before the trial court the day after the three-week period concludes. Failure to do so will result in his immediate arrest to face trial. This decision illustrates the judiciary's capacity to balance the stringent requirements of criminal law with pressing humanitarian needs, particularly when an accused has demonstrated trustworthy conduct during a prior release.
