INDORE: The High Court of Madhya Pradesh at Indore has granted temporary bail to an 18-year-old murder accused, enabling him to attend to his seriously ill father who requires urgent heart surgery. The court's decision, delivered on May 31, 2024, underscored the importance of humanitarian considerations, especially when the applicant had previously complied with bail conditions.

The counsel for the applicant, Shri Jitendra Sharma, did not press for regular bail. Instead, the plea was focused solely on securing temporary release on compassionate grounds. "...in view of medical condition of father of the applicant and also for the fact that applicant did not misuse the liberty of temporary bail granted to him earlier... I deem it fit to grant temporary bail to the applicant for a period of three weeks from the date of his release."
The High Court allowed the miscellaneous criminal case, directing the temporary release of the applicant for a period of three weeks. The release is subject to furnishing a personal bond of ₹50,000 with one solvent surety.
The court has strictly mandated that the applicant must surrender before the trial court the day after the three-week period concludes. Failure to do so will result in his immediate arrest to face trial. This decision illustrates the judiciary's capacity to balance the stringent requirements of criminal law with pressing humanitarian needs, particularly when an accused has demonstrated trustworthy conduct during a prior release.
