The Supreme Court has stated that the occurrence of a paper leak in the NEET-UG 2024 exam is undeniable, and whether a retest is necessary will depend on the extent and nature of the leak.
During the hearing of a batch of petitions challenging the NEET-UG 2024 exam, the Supreme Court bench led by Chief Justice of India DY Chandrachud posed several questions to the Union Government and the National Testing Agency (NTA) regarding the paper leak and the steps taken to identify the beneficiaries of the fraudulent practices.
Widespread Leak Through Social Media a Cause for Concern
The bench observed that if the leak occurred through electronic means and social media platforms like Telegram and WhatsApp, then the possibility of the leak being widespread is high.
"If we come to the conclusion that the time lag between the leak and the actual exam is limited, that will be a circumstance which will militate against the holding of a re-test," Chief Justice Chandrachud said.
However, the bench also acknowledged that ordering a retest for 23 lakh students would be an extreme decision and a tough task. The court said it would have to scrutinize three key factors:
Identifying Beneficiaries of the Fraud is Crucial
The court stated that in a situation where the breach in the sanctity of an examination has affected the entirety of the process, and it is not possible to segregate the beneficiaries of wrongdoing from others, it may be necessary to order a re-examination.
On the contrary, if the breach is confined to specific areas and it is possible to identify the wrongdoers, it may not be appropriate to order a re-test, especially in an exam involving 23 lakh students.
The court directed the NTA to make a full disclosure on the nature of the leak, the places where the leak took place, and the time lag between the occurrence of the leak and the conduct of the exam.
Measures to Ensure Exam Sanctity in the Future
The court also voiced concerns about steps to be taken in the future to ensure the sanctity of NEET, so that such instances are not repeated. This would include the constitution of a multi-disciplinary committee comprising renowned experts to make recommendations on reforming the examination process, improving data security protocols, and the structure and functioning of the NTA.
The hearing was adjourned, with the court asking the Union Government, CBI, and NTA to file their responses to the court's queries by July 10. The court will further consider the matter on July 11.
