Writ Jurisdiction
Subject : Civil Law - Service Law
In a recent order, the High Court of Judicature at Patna presided over by the Chief Justice and Hon'ble Mr. Justice Harish Kumar, has effectively resolved a writ petition in Sushil Kumar Singh vs. The State of Bihar by strictly adhering to an established legal precedent involving the Education Department.
The petitioner, Sushil Kumar Singh, had approached the High Court seeking relief via a Civil Writ Jurisdiction Case (CWJC No. 6205 of 2024). The matter involved disputes pertaining to the administrative functions of the State of Bihar, specifically concerning the Additional Chief Secretary of the Education Department.
During the proceedings, Mr. P.K. Shahi, the learned Advocate General acting for the State, informed the bench that the issues raised by the petitioner were not unique. He submitted that the questions of law and fact involved in this petition were identical to those addressed by a Division Bench in the case of Pramod Kumar & Ors Vs. the State of Bihar (CWJC No. 1942 of 2024), which was decided on April 2, 2024.
Counsel for the petitioner did not controvert this submission, acknowledging that the resolution provided in the Pramod Kumar decision was equally applicable to the facts at hand.
The brevity of the court's order underscores the importance of judicial consistency:
> "Mr. P.K. Shahi, learned Advocate General appearing on behalf of the State, submits that this case is squarely covered by a Division Bench judgment of this Court dated 02.04.2024 passed in CWJC No. 1942 of 2024 titled as Pramod Kumar & Ors Vs. the State of Bihar and its analogous cases, which is not controverted by the learned Counsel for the petitioners."
Recognizing the applicability of the clear precedent, the Court issued a short, decisive order:
> "Accordingly, the present writ petition stands disposed of in terms of judgment dated 02.04.2024 passed in CWJC No. 1942 of 2024 titled as Pramod Kumar & Ors Vs. the State of Bihar."
This decision serves as a reminder of the role of stare decisis in administrative and service-related litigation. By aligning the outcome with the Pramod Kumar case, the Court ensures standardized treatment for similarly situated litigants, effectively streamlining the judicial process and providing clarity for both the State and its employees.
