The Allahabad High Court has delivered a significant ruling clarifying the criteria for technical eligibility in public service examinations, holding that a Post Graduate Diploma in Computer Application (PGDCA) from an autonomous constituent of a university must be treated as equivalent to the 'O' level certificate issued by the DOEACC (now NIELIT).

The case arose from a dispute involving the petitioner, Abhinav Tiwari, who had applied for the post of Review Officer (RO) and Assistant Review Officer (ARO) in the U.P. Secretariat. While the selection process required an 'O' level certificate or an equivalent qualification, the Uttar Pradesh Public Service Commission (UPPSC) initially refused to recognize Tiwari's PGDCA certificate—issued by Ewing Christian College (ECC), an autonomous constituent of the University of Allahabad—as valid for the position.

The controversy centered on whether an autonomous institution under a recognized university holds the authority to grant certificates acceptable by the state employer.

The petitioner argued that the State Government, through its circular dated October 20, 2023, had explicitly recognized specific university-issued diplomas as equivalent to the 'O' level. Representing the petitioner, counsel argued that the state, as the primary employer, possesses the sole authority to determine equivalence, and that the UPPSC actied beyond its mandate by questioning these credentials.

Conversely, the UPPSC contended that the selection process for the 2016 advertisement had already reached its final stages. They argued that accepting a new interpretation of qualification validity at this late stage would disrupt the merit list, potentially setting a precedent that should only apply to future recruitment cycles rather than current ones.

The Court’s Analysis

Justice Ajit Kumar, presiding over the bench, prioritized the supremacy of the State Government's recruitment policy. Citing the principle that the prescription of qualifications is a matter of state policy, the Court noted that once the state clarifies that a specific qualification is equivalent, the recruiting body cannot adopt a contradictory, restrictive stance.

The Court reviewed the UGC’s 2012-17 guidelines, which clarify that autonomous colleges are empowered to initiate and certify diploma courses without prior individual approval from the parent university, thereby validating the status of ECC’s computer program.
