Addressing Concerns Over the Misapplication of the Law

The Allahabad High Court has raised concerns over the misuse of the Protection of Children from Sexual Offences (POCSO) Act, 2012, particularly in cases involving consensual romantic relationships between teenagers.

In a recent order, Justice Krishan Pahal emphasized the need for a "nuanced approach" and "careful judicial consideration" to ensure that the application of the POCSO Act does not inadvertently harm the very individuals it is meant to protect.

Distinguishing Genuine Exploitation from Consensual Relationships

The court noted that while the POCSO Act's primary objective is to safeguard children under the age of 18 from sexual exploitation, there have been instances where the law has been misused, especially in cases of consensual relationships between teenage individuals.

"The challenge lies in distinguishing between genuine cases of exploitation and those involving consensual relationships," the court said. "This requires a nuanced approach and careful judicial consideration to ensure justice is served appropriately."

Factors to Consider

The court outlined several key factors that should be taken into account when dealing with such cases:

  1. Assess the Context : Each case should be evaluated based on its individual facts and circumstances, with a close examination of the nature of the relationship and the intentions of both parties.

  2. Consider the Victim's Statement : The statement of the alleged victim should be given due consideration. If the relationship is consensual and based on mutual affection, this should be factored into decisions regarding bail and prosecution.

  3. Avoid Perversity of Justice : Ignoring the consensual nature of a relationship can lead to unjust outcomes, such as wrongful imprisonment. The judicial system should aim to balance the protection of minors with the recognition of their autonomy in certain contexts.

  4. Judicial Discretion : Courts should exercise their discretion wisely, ensuring that the application of the POCSO Act does not inadvertently harm the very individuals it is meant to protect.

The Case at Hand

The court's observations were made while granting bail to Satish Alias Chand , who had been booked under various sections of the Indian Penal Code and the POCSO Act for allegedly "enticing away" the complainant's minor daughter in June 2023.

Satish 's counsel argued that the victim was a consenting party, as evident from her statement recorded under Section 164 of the Code of Criminal Procedure, in which she claimed to be 18 years old. The counsel also submitted that the victim and the accused were in a consensual relationship and had eloped to get married in a temple, though their marriage was not officially registered.

Considering the circumstances, the court granted Satish bail on the condition that he would deposit a fixed deposit of Rs. 2,00,000 in the name of the victim's newborn child until she attains the age of majority.
