NEW DELHI — In a notable order, the Supreme Court of India on August 2, 2023, granted bail to a woman accused of abetting her husband's suicide, setting aside an earlier order from the Allahabad High Court. The bench, comprising Justice J.B. Pardiwala and Justice Manoj Misra , observed that the appellant had successfully made a case for her release.
The appellant, Kamana Naykar @ Kamana Singh, was charged under Sections 306 (Abetment of suicide) and 342 (Wrongful confinement) of the Indian Penal Code, 1860. The charges stemmed from an FIR registered on January 24, 2023, at Nawabad Police Station in Jhansi, Uttar Pradesh, following the suicide of her husband, Shyam Sundar.
The prosecution's case is that Ms. Naykar abetted the suicide of her husband. She had previously approached the High Court of Judicature at Allahabad for bail, but her plea was rejected in an order dated April 10, 2023, prompting her to appeal to the Supreme Court.
During the proceedings, the Supreme Court took special notice of a crucial development: Ms. Naykar's pregnancy. Recognizing this, the Court had earlier granted her interim bail through an order on June 30, 2023.
In its final order, the bench reviewed the materials on record and heard counsel for both the appellant and the State of Uttar Pradesh. Without delving into an elaborate discussion on the merits, the Court concluded that the appellant was entitled to regular bail.
The order stated:
"Having heard the learned counsel appearing for the parties and having gone through the materials on record, we are of the view that the appellant (accused) – Kamana Naykar @ Kamana Singh has been able to make out a case for release on bail."
The Supreme Court formally set aside the impugned order of the Allahabad High Court and allowed the appeal. Ms. Naykar was ordered to be released on bail, with the trial court given the authority to impose necessary terms and conditions.
The decision underscores the judiciary's approach to considering personal circumstances, such as pregnancy, as a significant factor in bail matters, even in cases involving serious allegations. While the order does not comment on the merits of the abetment charge, it ensures the appellant's liberty during the pendency of the trial. The case will now proceed before the trial court in Jhansi.
