Leave granted.
Heard learned counsel for the appellant and the State.
The respondent Nos. 4 and 5 have already been deleted from the array of parties. None appears on behalf of the respondent No.3 when the matter is called on for hearing.
This matter arises out of a petition for quashing an F.I.R. in which the appellant was named as an accused along with certain other persons. On 18th December, 2019, this Court had directed that in the event of the arrest of the appellant, she shall be released on furnishing personal bond of Rs.25,000/- with one surety of the like amount, to the satisfaction of the arresting Officer, or the nearest Magistrate.
Today, we are apprised by the learned counsel for the State that chargesheet has been submitted. In such circumstances, the appellant’s custody, in our opinion, is not necessary, pending further proceeding in the subject-case. Let the appellant participate in the trial. We confirm the order passed by this Court on 18.12.2019, but this order shall be subject to the outcome of the proceeding that would follow submission of the chargesheet.
With this observation, we dispose of this appeal.
