Sets Compensation at Rs. 222/sq. yard for 2000 Acquisition and Rs. 250/sq. yard for 2001 Acquisition
Chandigarh: The High Court of Punjab and Haryana, in a significant ruling, has enhanced the compensation awarded to landowners whose lands in Faridabad were acquired by the State of Haryana through notifications issued in 2000 and 2001. A division bench comprising Justice Ajay Kumar Mittal and Justice Raj Rahul Garg disposed of a batch of Regular First Appeals (RFAs), including the lead case of Samundar Singh vs. State of Haryana and Anr. (RFA 587 / 2009) , by applying a 12% per annum increase on a 1997 base market value.
The appeals pertained to two separate land acquisitions in Villages Aurounda and Pehladpur, Sector 10A and 10B, Faridabad, initiated under the Land Acquisition Act, 1894:
1. Notification dated March 18, 2000 : For acquiring land for development.
2. Notification dated September 05, 2001 : For acquiring "leftover patches" of land in the same sectors.
Landowners had approached the High Court seeking enhancement of the compensation awarded by the Land Acquisition Collector, while the State of Haryana had filed appeals seeking a reduction in some instances. The central legal question revolved around determining the fair market value of the acquired lands at the time of the respective notifications.
The High Court meticulously examined previous adjudications and the specific nature of the acquired lands.
Referencing Past Adjudications: The Court noted that a batch of appeals related to the March 18, 2000 notification had previously been decided by the High Court in RFA-2077-1993 (Sube Singh vs. State of Haryana) on May 16, 2012, where the market value was assessed at Rs. 185/- per sq. yard. Appeals against this decision were disposed of by the Supreme Court on December 10, 2015. The Supreme Court had dismissed the State's Special Leave Petition concerning the 2000 notification (thereby upholding Rs. 185/- for those specific cases) and had remanded matters concerning the 2001 notification (where the High Court had fixed Rs. 195/-) back to the High Court for fresh consideration of enhancement.
Calculating Fair Market Value for the Current Batch: For the present batch of appeals, particularly concerning the "leftover patches" from the March 18, 2000 notification, the High Court adopted a different base. It observed that these lands were remnants from a major acquisition initiated via a notification dated September 06, 1997, where the market value was established at Rs. 170/- per sq. yard.
The Court reasoned: > "It is evident that the present notification dated 18.03.2000 is with respect to the left out portion/patches of land whereas notification for acquiring major part of the land located in Sector 10A and 10B was issued on 06.09.1997."
Finding no difference in the location of the land acquired in 1997 and the leftover patches in 2000, the Court deemed it appropriate to apply a 12% annual increase to the 1997 base value.
For the March 18, 2000 Notification: The time difference between September 06, 1997, and March 18, 2000, was approximately 2 years, 6 months, and 12 days. The Court calculated the market value as: Rs. 170/- (base) + (12% of Rs. 170/- for 2 years, 6 months, 12 days, amounting to Rs. 52/-) = Rs. 222/- per sq. yard.
For the September 05, 2001 Notification: Similarly, for the lands acquired via the 2001 notification (also leftover patches), the Court applied the 12% annual increase on the 1997 base value of Rs. 170/-. The time difference was approximately 3 years and 11 months. The Court calculated the market value as: Rs. 170/- + (12% of Rs. 170/- for 3 years and 11 months, amounting to Rs. 79.88/-) = Rs. 249.88/-, which was rounded off to Rs. 250/- per sq. yard.
Based on these calculations, the High Court:
* Allowed the appeals filed by the landowners.
* Dismissed the appeals filed by the State of Haryana.
* Fixed the market value for land acquired under the notification dated March 18, 2000, at Rs. 222/- per sq. yard.
* Fixed the market value for land acquired under the notification dated September 05, 2001, at Rs. 250/- per sq. yard.
The landowners will also be entitled to all statutory benefits under the Land Acquisition Act, 1894, including solatium and interest, on the enhanced compensation. The Court directed that any pending miscellaneous applications also stand disposed of. The State was directed to deposit the compensation amount, if not already disbursed, within 12 weeks from the date of the Supreme Court's earlier order (December 10, 2015), with liberty to the claimants to withdraw the same. The High Court was also requested by the Supreme Court to expedite hearings for remanded matters, preferably within six months.
