Navigating the Grey Zone: Rajasthan High Court Sets Clear Rules on Seized Mining Vehicles

In a verdict aimed at bringing relief to vehicle owners entangled in mining law violations, the Rajasthan High Court has provided a definitive roadmap for the release of seized vehicles. Justice Baljinder Singh Sandhu, presiding over the case of Babu Lal v. State of Rajasthan , ruled that the legal authority to grant custody of a vehicle depends entirely on whether the Mines and Minerals Department has formally initiated confiscation proceedings.

The Backdrop: A Dispute Over Asset Release

The petitioner, Babu Lal, had approached the High Court seeking the release of his vehicle (No. RJ-06-RE-0792) following its seizure by state authorities for alleged violations of the mining laws. The crux of the legal tussle was not the merits of the mining violation itself, but the procedural ambiguity regarding when a criminal court can intervene to grant "supurdaginama" (custody) of such property.

The Benchmarking Precedent: The Chaina Ram Doctrine

To resolve the case, the Court looked to the precedent set in Chaina Ram v. State of Rajasthan (2025) . This ruling serves as the primary guidance for all district courts across the state. The legal principle established is binary:

  1. If Confiscation has Begun: If the Mining Department has already initiated official confiscation proceedings against a vehicle, the criminal court’s hands are effectively tied. In such instances, the vehicle cannot be released on supurdaginama ; the owner’s only remedy is to pay the prescribed penalty and compounding fees to the mining authorities.
  2. If Confiscation is Pending: If no such proceedings have commenced, the jurisdiction lies with the competent criminal court, which may grant interim custody to the true owner to prevent the vehicle from languishing in police custody unnecessarily.

Key Observations

The Court emphasized the fine balance between regulatory enforcement and the rights of vehicle owners, specifically noting:

  • "It is held that under the mining laws, the state authorities have the powers for initiating confiscation proceedings in relation to the vehicles seized for violation of the mining laws."
  • "Once, the confiscation proceedings are initiated, the vehicle cannot be released on supurdaginama as prayed by few of the petitioners. However, the said vehicles can only be released on payment of penalty and compounding fees."
  • "Whereas, the vehicles qua which no confiscation proceedings have yet been commenced, the competent criminal Court can handover interim custody of the vehicles to its true owner."

The Verdict and Its Impact

Observing that the petitioner’s case was squarely covered by the Chaina Ram ratio, Justice Sandhu set aside the impugned order dated 30.03.2026. The High Court has granted the petitioner liberty to file a fresh application before the competent court. The lower court has been directed to evaluate this new application based strictly on the status of confiscation proceedings at the time of the request.

For vehicle owners, this ruling acts as a critical procedural shield, clarifying that while environmental and mining regulations are stringent, the state cannot indefinitely deny custody of property without following the requisite confiscation processes.
