In a significant administrative directive, the Rajasthan High Court has provided a clear roadmap for citizens seeking to address grievances regarding the encroachment of government land. Presiding over the case of Ramji Lal Saini vs. The State of Rajasthan , Justice Anuroop Singhi underscored the procedural necessity of utilizing designated forums to handle such disputes efficiently.
The petitioner, Ramji Lal Saini, a 48-year-old resident of Manpura village in Dausa district, had approached the High Court seeking a judicial mandate to compel the state authorities to remove unauthorized encroachments on local government land. Despite having previously filed a representation before the District Collector of Dausa, the petitioner asserted that the matter remained unaddressed, prompting his formal application to the High Court under Article 226.
The petitioner’s counsel argued that the failure of local administrative bodies to act upon legitimate representations regarding public land depletion warranted high-level judicial intervention. Relying on the precedent set by the Division Bench in Jagdish Prasad Meena & Ors. Vs. State of Rajasthan & Ors. (2019), the petitioner requested the Court to facilitate a mechanism where his grievances could be formally reviewed and adjudicated by the Public Land Protection Cell (PLPC). The State, represented by the presence of its administrative wings, did not contest the procedural efficiency of the PLPC mechanism.
Justice Anuroop Singhi’s decision was grounded in principles of administrative efficiency and adherence to existing judicial frameworks. Instead of issuing a specific directive to remove the encroachment directly, the Court reaffirmed the authority and relevance of the PLPC. This body, formed in compliance with the Jagdish Prasad Meena ruling, acts as the primary specialized forum for handling public land complaints. By directing the petitioner back to this specialized body, the Court ensures that facts can be verified by land revenue experts rather than via protracted litigation.
Highlighting the importance of proper administrative recourse, the Court noted:
The High Court has instructed the petitioner to file a formal representation before the district-level PLPC. The Cell is now mandated to hear the petitioner’s concerns and arrive at a reasoned decision within a two-month timeframe.
This ruling serves as a vital reminder to litigants that for public land grievances, administrative remedies like the PLPC must be exhausted before the judiciary intervenes. By streamlining this process, the Court promotes administrative accountability while ensuring that villagers like Saini have a clear path to seek justice for the preservation of communal lands.
