Kidneys of the Landscape: Rajasthan High Court Intervenes to Save State’s Vanishing Wetlands

In a landmark move to address the ecological crisis unfolding across the desert state, the Rajasthan High Court has taken suo motu cognizance of the severe degradation of its wetland ecosystems. Citing their critical role as "kidneys of the landscape," a division bench comprising Dr. Justice Pushpendra Singh Bhati and Justice Rekha Borana has initiated formal legal proceedings to ensure the survival of thousands of water bodies that sustain the state's biodiversity and water security.

A Landscape in Peril The court’s intervention was prompted by disturbing media reports in local daily Rajasthan Patrika , which highlighted that of the approximately 46,748 identified wetland units in Rajasthan, only a negligible fraction has been brought under statutory protection. These wetlands, which serve as essential groundwater recharge zones, flood buffers, and habitats for migratory birds, are currently suffering from unmitigated discharge of untreated sewage, solid waste dumping, and rampant encroachment.

The Constitutional Mandate The High Court underscored that the protection of these ecosystems is not merely a policy choice but a fundamental constitutional duty. By invoking Article 21—the right to a healthy environment—and Article 48A, which mandates that the state protect and improve the environment, the Bench asserted that the "Public Trust Doctrine" prevents the state from remaining a silent spectator to the destruction of these vital resources.

"The continued degradation, pollution, encroachment and disappearance of wetlands not only threatens biodiversity and ecological balance but also undermines water security, climate resilience and the quality of life of present and future generations," the Court noted.

Judicial Directions: A Time-Bound Roadmap Setting a strict judicial standard, the Bench issued a comprehensive set of directives requiring the State Government to submit detailed status reports. The Court has ordered: * District-wise Inventories : Immediate mapping and identification of all wetlands, including their geographical extent and ownership status. * Preventive Action : An absolute prohibition on further encroachment, reclamation, or construction on identified wetland areas. * Pollution Control : Mandatory assessment of sewage inflow and municipal waste dumping, with specific directives to prevent further contamination. * Expert Consultation : The government has been ordered to engage with hydrologists, ornithologists, and environmental scientists to formulate long-term conservation plans. * Amicus Curiae Appointment : Advocates Jubin Mehta, Divik Mathur, and Harshvardhan Singh Rathore have been appointed to assist the Court in the proceedings.

"Wetlands, by virtue of their ecological significance and public utility, are resources held by the State in trust for the benefit of the public under the well-recognized Public Trust Doctrine ."
