While presiding over a miscellaneous application for the condonation of a 450-day delay in a motor accident claim appeal, Justice Anoop Kumar Dhand opted to address the structural inequalities facing first-generation lawyers rather than simply dismissing the plea.

A Condition for Justice

The matter, Smt. Meena Devi v. Rahul Haldiya , involved an appellant who struggled to explain a massive 450-day delay in filing an appeal against a judgment from the Motor Accident Claims Tribunal, Dausa. While Justice Dhand expressed clear dissatisfaction with the reasons provided for the delay, he permitted the appeal to proceed under a unique condition: the appellants must deposit Rs. 11,000 into a newly created "Junior Advocates Welfare Fund for purchasing Law Books."

The Struggle of the Budding Lawyer

The court utilized this case as a platform to highlight the harsh realities faced by young advocates, particularly those who lack familial background in the legal profession. Justice Dhand noted that long working hours, low fixed income, and a lack of access to basic resources like law books or shared workspaces often force talented individuals out of the profession prematurely.

"A strong legal system needs strong Young Advocates. If they get proper support in the beginning, they can become honest and skilled professionals," the court observed, emphasizing that a lack of systemic support only weakens the justice delivery mechanism.

Key Observations

The judgment offers a profound critique of the current state of mentorship and welfare for lawyers: - "The first generation young budding lawyers have no support to establish their practice and they have no resources to purchase the necessary law books, which are required by them every day." - "Young Advocates need shared chambers or fixed seating in courts. Even a simple table and chair can make a big difference." - "Mentorship programs can help a lot. Regular guidance sessions, open discussions, and learning support can improve confidence."

Moving Towards Institutional Change

Beyond the specific case, the Court has mandated the formalization of support structures. Justice Dhand directed the Rajasthan High Court Bar Association to open a dedicated bank account at the SBI High Court Branch. Furthermore, the Court ordered state-wide implementations through "The Rajasthan Advocates (Aid to purchase Law Books) Scheme," which includes:

  1. Financial Aid: A one-time grant of Rs. 5,000 for lawyers under 28 with less than five years of practice.
  2. Accountability: Recipients must produce cash memos for books purchased within one month, failing which the aid is recoverable with interest.
  3. Voluntary Contribution: Encouragement for senior advocates to donate to the welfare fund.

Implications for the Future

The decision represents a shift in judicial policy, moving the courtroom from a site of strictly adversarial proceedings to one that actively cultivates the next generation of legal talent. By linking procedural leniency to the welfare of the bar, the Rajasthan High Court is setting a precedent that the health of the justice system is inextricably linked to the prosperity of its youngest members.
