Subject : Constitutional Law - Writ Petition
JODHPUR: The Rajasthan High Court at Jodhpur has taken the significant step of issuing a notice to its own administration in a writ petition filed by Mr. Vivek Firoda. The order was passed by a Division Bench comprising Justice Bipin Gupta and Justice Dr. Pushpendra Singh Bhati.
The matter, titled Vivek Firoda vs The Rajasthan High Court (Civil Writ Petition No. 11003/2025) , was brought before the court by the petitioner, Mr. Firoda. While the specific grounds of the petition were not detailed in the initial order, the case involves a legal challenge where the High Court itself is named as the respondent.
The petition was heard on August 20, 2025. After preliminary consideration, the Bench determined that the case presented questions that warrant a formal response from the respondent.
In a brief but crucial procedural order, the Division Bench directed:
“Issue notice to the respondents.”
This order signifies that the court has found the petition to have sufficient merit for admission and has formally initiated proceedings. The Rajasthan High Court, in its administrative capacity as the respondent, is now required to file its response to the allegations and legal questions raised in Mr. Firoda's petition.
The issuance of a notice is the first substantive step in a writ proceeding. It indicates that the court, after a prima facie review, believes the petitioner's case requires further examination. The matter will now proceed to the next stage, where the respondent (the High Court administration) will present its defense. The case's progression will be closely watched, as it involves the judiciary examining a challenge directed at its own administrative functions.
