Rajasthan High Court Stays RUHS-CUET 2026 Counseling Over Government's Failure to Process Pending NOC Applications

The Rajasthan High Court, presided over by Justice Mukesh Rajpurohit, has ordered an immediate stay on the admission counseling schedule for B.Sc. Nursing, D.Pharm, and B.P.T. courses issued by the Rajasthan University of Health Sciences (RUHS). The decision comes in the wake of prolonged administrative inaction regarding the grant of No Objection Certificates (NOCs) to numerous private nursing institutions.

A Pattern of Administrative Delay The dispute stems from a large batch of writ petitions filed by private educational societies across Rajasthan. Following new government guidelines issued on October 15, 2024, these institutions invested in infrastructure and facilities to meet established criteria. Despite fulfilling the requirements and paying the necessary fees, their applications for NOCs remained pending for over eighteen months.

The petitioners argued that, despite repeated assurances from the state government to finalize these applications, the authorities failed to act. The situation reached a breaking point when the Rajasthan University of Health Sciences (RUHS) notified the counseling schedule on June 11, 2026, while the applications for the very institutions they represent were still languishing in bureaucratic limbo.

The Conflict of Interests The State Government, represented by Additional Advocate General N.S. Rajpurohit, requested additional time to finalize the pending applications, citing the complexity of policy decisions being considered by a Higher Level Committee. However, the Court found this justification insufficient. The Court noted that earlier promises provided to the bench in previous hearings—that no counseling notification would be issued until the NOC issues were resolved—had been undermined by the recent notification.

Key Observations Justice Mukesh Rajpurohit emphasized the prejudice caused to the institutions, stating:

  • " Prima facie , the conduct of the respondent authorities in simultaneously withholding a decision on the pending applications for NOCs while initiating the admission process cannot be countenanced."
  • "This Court cannot lose sight of the fact that the applications submitted by the petitioner-institutions... have remained pending for more than one and a half years."
  • "If the counselling process is permitted to proceed before adjudication of the pending applications... the petitioner-institutions... would suffer irreparable prejudice ."

Legal Precedent and Conclusion The Court drew heavily from the division bench judgment in Fortune Foundation & Anr. vs. State of Rajasthan & Ors. (D.B. Civil Writ Petition No. 23307/2025). That precedent established that applications for NOCs must be decided at least 45 days prior to the commencement of centralized counseling. By initiating the counseling process without finalizing these applications, the State failed to comply with established judicial directives.

Consequently, the Court held that the RUHS CUET-2026 Counseling and Allotment Schedule shall remain in abeyance until the next date of hearing, scheduled for July 15, 2026. This move effectively forces the State to prioritize the resolution of the pending institutional applications before proceeding with the current academic year's student admission process.
