In a significant ruling, the High Court of Tripura addressed the case of Sri Shasanka Nath Chowdhury , a retired employee of the Tripura Handloom & Handicrafts Development Corporation Ltd. He contended that the gratuity and other benefits should have been paid within 30 days of his retirement, as stipulated by law. The respondents, including the Tripura Handloom & Handicrafts Development Corporation, countered that payments were made in installments and cited financial constraints as reasons for the delays.
The court examined the provisions of the Payment of Gratuity Act, particularly Section 7, which mandates that gratuity payments must be made within 30 days of becoming payable. The court noted that the respondents admitted to the delays in payment and that the financial difficulties of the corporation could not excuse the failure to comply with statutory obligations. Citing precedents, the court emphasized that delays in payment of retirement benefits constitute a continuing wrong, thus entitling the petitioner to interest on the delayed amounts.
The High Court ruled in favor of the petitioner, directing the respondents to calculate and pay the interest at a rate of 7.5% per annum on the delayed gratuity and other benefits from the date they became due until actual payment. The court mandated that the respondents complete this payment within three months, ensuring that the petitioner receives his rightful dues without further delay. This decision reinforces the legal rights of retired employees regarding timely payment of their retirement benefits.
