Subsequently, the Odisha Subordinate Statistical Surveyors (Method of Recruitment and Conditions of Service) Rules, 2015, superseded the 1994 rules, coming into effect on September 8, 2015.

The Dispute: In 2019, the Odisha government issued letters directing Swain 's dismissal, claiming his appointment was illegal because it didn't adhere to the 2015 rules. The government argued that the selection committee that appointed Swain was not constituted according to the 2015 regulations.

Arguments Presented: Swain 's legal counsel argued that his appointment predated the 2015 rules and was valid under the 1994 rules. They highlighted that the selection process was completed before the new rules came into force. The government, conversely, maintained that the 2015 rules should be applied retroactively, rendering Swain 's appointment invalid regardless of the timing of the selection process.

Court's Reasoning: Justice Murahari Sri Raman , in their judgment dated February 20, 2025, carefully analyzed the legal framework. The court noted that the 2015 rules explicitly stated that they superseded the 1994 rules but contained a crucial caveat: "except as respects things done or omitted to be done before such supersession." The court interpreted this clause as preventing the retroactive application of the 2015 rules to appointments made under the 1994 rules, prior to their supersession.

The judgment further emphasized that the government's action was taken based on a "preconceived notion" of illegality, without proper due process or investigation. The court highlighted the flaw in the government's argument that the appointment was irregular in accordance with the 2015 rules as the selection was made prior to the rules' implementation. The court cited a previous Division Bench decision ( State of Odisha v. Sreepati Ranjan Dash, 2023 SCC OnLine Ori 6207 ) to support its interpretation of the principle of supersession and retroactive application of rules.

Decision and Implications: The Orissa High Court quashed the termination order and directed the reinstatement of Ranjan Kumar Swain with all back pay and benefits. This ruling reinforces the importance of the correct interpretation of legal provisions, especially when it comes to the retroactive application of newly enacted rules.
