Extension of Deadline for Opening Brief in Capitol Riot Appeal

WASHINGTON, D.C. (KNWA/KFTA) — The lawyer of a Gravette man convicted on multiple insurrection charges was granted a three-month extension to file the opening brief in his Capitol riot appeal, according to court documents filed on Friday.
Richard Barnett, 63, was found guilty in Jan. 2023 on eight counts related to the January 6 insurrection at the U.S. Capitol in 2021.
The federal public defender representing Barnett, Courtney Millian, requested on Feb. 13 for the deadline for opening briefs to be extended from Feb. 20 to May 13, three months after the motion was filed.
Millian wrote in the request that she “has been unable to receive all discovery materials from trial counsel.”
The new due date for the brief is set for May 13.
The motion says that an oral argument has not been scheduled and the government does not oppose the motion.
