The Supreme Court on Friday directed all courts to ensure that no litigant suppresses facts while seeking bail. A bench of Justices S.K. Kaul and A.S. Oka said that courts should mention details of previous bail applications and orders in all bail pleas. The bench was hearing a plea filed by advocate Prashant Bhushan, who had challenged the grant of bail to Alt News co-founder Mohammed Zubair by the Allahabad High Court. Bhushan had argued that the high court had failed to consider the fact that Zubair had been granted bail in a similar case by the Supreme Court earlier. The bench agreed with Bhushan's contention and said that courts should take into account all relevant factors while considering bail applications. The bench also said that courts should not grant bail to accused persons who have a history of suppressing facts. The bench's order is a significant development as it will help to ensure that courts do not grant bail to accused persons who are trying to hide their criminal history. It will also help to prevent courts from being misled by accused persons who are trying to suppress facts in order to obtain bail.
