Security Deposit Refund Denied for Supplying Inferior Quality Feeds
A company's counterclaim for the return of a security deposit was denied by a court due to the supply of inferior quality cattle and poultry feeds. The court found that the feeds supplied by the defendants were generally of poor quality, even though the plaintiffs could not prove that a specific 80 MT of feed was defective.
The court held that the security deposit was not only for the 80 MT of feed in question but for the entire contract. Therefore, the failure to prove the inferiority of that specific quantity did not entitle the defendants to a refund. The court also considered evidence from various sources, including farmers, veterinarians, and analytical reports, to establish the poor quality of the feeds.
The decision highlights the importance of suppliers fulfilling their contractual obligations by providing goods of the agreed quality. It also emphasizes the significance of security deposits in ensuring that suppliers adhere to the terms of the contract and deliver satisfactory products or services.
