NEW DELHI – The legal battle surrounding the murder of Armstrong, a prominent Dalit activist and Bahujan Samaj Party (BSP) leader, has intensified with his wife, Porkodi, filing an intervention application in the Supreme Court. The application robustly supports the transfer of the investigation to the Central Bureau of Investigation (CBI) and further requests that the probe be conducted under the oversight of a Supreme Court-monitored committee.
The case, which Porkodi's application describes as having a bearing on the "national conscience," adds a new dimension to the ongoing Special Leave Petition (SLP) filed by the State of Tamil Nadu. The state is challenging a Madras High Court order that invalidated the state police's chargesheet and mandated a CBI inquiry into the brutal murder.
Armstrong was hacked to death by a group of armed assailants outside his residence in Perambur, Chennai, on July 5, 2024, a crime that sent shockwaves through political and activist circles.
The matter reached the apex court after the Tamil Nadu government contested the September 24 order by Justice P Velmurugan of the Madras High Court. Acting on a petition filed by Armstrong's brother, Keynos, the High Court had found significant deficiencies in the state police's investigation, citing "procedural lapses in the investigation and material contradictions in the chargesheet." Consequently, it quashed the police chargesheet and transferred the case to the CBI to ensure a fair and impartial probe.
On October 10, the Supreme Court partially intervened, staying the High Court's decision to quash the chargesheet filed by the state police. However, in a crucial move, the bench did not interfere with the High Court's directive for the CBI to take over the investigation. This decision has allowed the central agency's probe to proceed, creating a complex procedural landscape where the CBI investigation coexists with a stayed but not invalidated state chargesheet.
It is within this legal framework that Porkodi has filed her intervention application, seeking not only to support the CBI probe but to fortify it with judicial supervision and enhanced safeguards for those involved.
In her application, filed through Advocate on Record Rahul Shyam Bhandari, Porkodi argues that the state police's investigation was fundamentally flawed and biased. She contends that a fresh, independent inquiry is imperative to unearth the complete conspiracy behind her husband's murder.
"Various important facts were deliberately omitted in the charge-sheet which have clear nexus with the motive and intent with which this dastardly crime has happened," the application states. "Various facts which goes to the root of the matter and requires a fair relook in the nature of de-novo investigation since the earlier investigation has been prima facie found deficient and impartial by the High Court."
Citing these alleged omissions and the partiality of the initial probe, Porkodi has called for the formation of a Supervisory Committee headed by a former Supreme Court Judge to monitor the CBI's investigation. She draws a parallel with the Karur stampede case, where a similar mechanism was employed to ensure accountability and thoroughness in a sensitive investigation. This demand underscores a deep-seated distrust in the state machinery and a plea for the highest level of judicial oversight to guarantee justice.
Furthermore, the application formally requests protection for witnesses under the Witness Protection Scheme, 2018 . This highlights grave concerns about potential intimidation and threats to individuals who may come forward with crucial evidence, a common challenge in high-profile cases involving influential figures.
Porkodi also informed the court that she had independently filed a petition in the Madras High Court to challenge the state police investigation. However, with the substantive legal questions now before the Supreme Court in the state's SLP, she noted that the High Court is unlikely to proceed with her petition, making the intervention at the apex court level her primary recourse.
