State Bar Council Staff Appointments Quashed By High Court

In a significant ruling concerning the integrity of administrative appointments in professional regulatory bodies, the High Court of Madhya Pradesh has set aside the out-of-turn promotions and subsequent appointments of Smt. Geeta Shukla to the positions of Assistant Secretary and Secretary of the State Bar Council.

The division bench led by Chief Justice Sanjeev Sachdeva and Justice Vinay Saraf delivered the judgment, ruling that the State Bar Council bypassed established recruitment rules and mandatory qualifications, effectively overriding the statutory framework of the Advocates Act, 1961 .

The Illegal Ladder: Bypassing Hierarchy

The dispute arose from two writ petitions challenging the sudden elevation of Smt. Geeta Shukla. Originally employed as a Lower Divisional Clerk (LDC), she was promoted to the position of Assistant Secretary in 2022 and subsequently to Secretary in July 2024. Petitioners contended that this "acceleration" involved skipping six intermediate hierarchical posts without any provision in the service rules for such an out-of-turn promotion.

The Court noted that Smt. Geeta Shukla had failed to meet the requisite qualification criteria during a formal recruitment examination held in 2019, where she ranked 12th out of the applicants. Despite this, the State Bar Council, under the guise of an "Acting Secretary" arrangement due to administrative vacancies, installed her in the higher posts.

Arguments and The Court's Reasoning

The State Bar Council’s defense rested on "special circumstances," claiming no other employee was willing to shoulder the responsibilities of the Secretary post. They argued that the Chairman possessed general control and supervision powers under Rule 109 to make necessary ad-hoc appointments.

The Court rejected this premise firmly. Citing the Advocates Act, 1961 , the bench highlighted that the post of Secretary is a statutory position requiring strict adherence to prescribed qualifications, including a law degree and five years of standing as an advocate.

Key Observations

The judgment underscores the limitations of administrative discretion when it conflicts with mandatory service rules:

  • "Power of general control and supervision granted to the Chairman does not empower him to ignore the mandate of the General Rules and the Service Rules framed by the Bar Council."
  • "A jump of six posts is not sustainable even for an exceptionally meritorious candidate."
  • "If that were the position [lack of willing staff], the State Bar Council should have taken immediate steps for appointing a qualified Secretary... and not permitted a non-qualified person to continue as the Acting Secretary for a period of four years."

The Court's Directive: A Return to Compliance

The High Court has ordered the following immediate actions: 1. Reversion: Smt. Geeta Shukla is to be reverted to her substantive post of LDC. 2. Fresh Recruitment: The Council must set the process in motion to hire a Secretary in strict compliance with the rules and qualifications within two months. 3. Transparency: A fresh recruitment process for the Assistant Secretary position must also be conducted based on the criteria established in the council's own 2019 advertisement. 4. Ad-Hoc Interim: An appropriately qualified person must be appointed as an Ad-hoc Secretary to oversee the transition until a permanent appointment is made.

This ruling serves as a stark reminder to statutory bodies that administrative convenience cannot override codified service recruitment protocols, particularly for roles involving significant legal and regulatory responsibilities.
