Supreme Court Consolidates FIRs Against Filmmaker, Grants Protection from Coercive Action

The Supreme Court of India has issued a significant order in Writ Petition (Criminal) No. 8/2023 , consolidating multiple First Information Reports (FIRs) filed against filmmaker Leena Manimekalai and granting her protection from coercive action. The judgment, delivered on April 10, 2023, by a bench comprising the Chief Justice and Justices Pamidighantam Sri Narasimha and J.B. Pardiwala , highlights the Court's intervention in preventing potential harassment arising from the multiplicity of FIRs.

Case Background

Leena Manimekalai faced multiple FIRs across various states—Delhi, Uttar Pradesh, Madhya Pradesh, and Uttarakhand —stemming from alleged offenses related to her film. These FIRs, numbered 194/2022 (Delhi), 0239/2022 (UP), 0481/2022 (MP), 0110/2022 (MP), 0288/2022 (MP), and 0213/2022 ( Uttarakhand ), were filed between July 4th and July 8th, 2022.

Court's Intervention

On January 20, 2023, the Supreme Court, while issuing notice on the petition, expressed its inclination to consolidate all FIRs in a single location. This would allow the petitioner to pursue her remedies under Section 482 of the Code of Criminal Procedure, 1973 (CrPC), which empowers High Courts to quash criminal proceedings. The Court, as an interim measure, directed that no coercive steps be taken against Manimekalai based on the existing or future FIRs related to the same film.

The Decision

Following arguments from both parties, the Supreme Court ordered the transfer of FIRs (b) to (f) listed in the judgment to the IFSO Unit, Special Cell, Delhi. This consolidation aims to streamline the investigation process. The Court further clarified that Manimekalai is at liberty to approach the Delhi High Court under Section 482 of the CrPC to address any grievances.

The Court's interim order from January 20, 2023, protecting the petitioner from coercive steps, will remain in effect until a final report under Section 173 of the CrPC is submitted by the Investigating Officer.

Implications

This decision underscores the Supreme Court's commitment to preventing abuse of the legal process and protecting individuals from potential harassment through the filing of multiple FIRs for the same alleged offense.
