Subject : Service Law - Recruitment
New Delhi – The Supreme Court of India has intervened in the recruitment process for 15,628 school teacher positions in Telangana, ordering a "status quo" on a High Court decision that had previously halted the selection process. The ruling effectively pauses the High Court's order, allowing the state government to proceed with the recruitment drive for now.
The case, titled The State of Telangana & Ors. vs Kalluri Naga Narasimha Abhiram & Ors. , was brought before the apex court after the Telangana government challenged the High Court's interim stay.
The controversy began when the Telangana government issued a notification for the District Selection Committee (DSC) Exam 2024 to fill thousands of teaching vacancies across the state. Several candidates, including Kalluri Naga Narasimha Abhiram, challenged the recruitment process before the Telangana High Court.
The petitioners raised objections concerning the methodology of the recruitment, including issues related to the allocation of posts and reservation policies. Agreeing with the petitioners' initial arguments, the High Court issued an interim order on May 3, 2024, staying all further proceedings related to the recruitment notification. This decision brought the entire hiring process to an abrupt standstill, affecting thousands of aspirants.
Aggrieved by the High Court's stay, the State of Telangana filed a Special Leave Petition before the Supreme Court. The government argued that the High Court's blanket stay was unwarranted and would severely delay the filling of crucial teaching positions in government schools, ultimately impacting the education of students. They contended that any procedural issues could be addressed without halting the entire recruitment process.
After hearing the preliminary arguments, the Supreme Court issued a notice on the petitions and ordered that the status quo, as it existed before the High Court's stay order, be maintained. The Court's order stated:
"Issue notice. Until further orders, status quo, as it existed prior to the passing of the impugned order, shall be maintained."
This directive effectively suspends the High Court's stay order.
The Supreme Court's "status quo" order means the Telangana High Court's stay is temporarily lifted. This allows the state government to resume the recruitment process for the 15,628 teacher posts as per the original schedule, pending a final decision from the Supreme Court.
The matter will now be heard in detail by the Supreme Court, which will examine the legal and procedural questions raised by the original petitioners. The final outcome of this case will be critical for the future of teacher recruitment in Telangana and will set a precedent for how courts handle challenges to large-scale public employment processes.
