Withdrawal of PIL Challenging Fundamental Rights
Subject : Constitutional Law
The Supreme Court of India has allowed the withdrawal of a Public Interest Litigation (PIL) that challenged the fundamental rights provided to citizens under Articles 20 and 22 of the Constitution. The PIL was filed by Tamil Nadu resident PK Subramanian through lawyer Naresh Kumar. The apex court had expressed displeasure over Advocates on Record (AoRs) unmindfully appending their signatures to such petitions. The bench comprising Chief Justice D Y Chandrachud and justices JB Pardiwala and Satish Chandra Sharma said, "We are not monsters. We will permit you to withdraw the case." The CJI, however, said the AoRs must realize the responsibility which they have to shoulder.
