Supreme Court Upholds Revised Pay Scales for Education Department Officials in Uttar Pradesh

Background

The case centered around a long-standing dispute over the pay scales of Sub-Deputy Inspectors of Schools/Assistant Basic Shiksha Adhikaris (SDI/ABSA) and Deputy Basic Shiksha Adhikaris ( DBSA ) in the Uttar Pradesh Basic Education Department. The issue arose after the pay scales of Headmasters of Junior High Schools were revised in 2001, but the pay scales of SDI/ABSA and DBSA were not correspondingly updated.

Arguments

The SDI/ABSA and DBSA argued that their pay scales should be on par with the Headmasters, as they were responsible for supervising the work of the Headmasters. The state government, on the other hand, contended that the financial implications of granting the higher pay scales would be an enormous burden of around ₹1,500 crores on the state exchequer.

Court's Analysis and Reasoning

The Supreme Court noted that the state government had previously acknowledged the pay anomaly and had taken steps to rectify it, including the creation of a new post of "Block Education Officer" by merging the SDI/ABSA and DBSA cadres. The court held that the state government's actions were in compliance with the court's earlier orders and that the doctrine of merger applied, meaning the High Court's previous judgment had been subsumed by the Supreme Court's order.

The court also observed that while the state authorities had been negligent in filing the intra-court appeal in a timely manner, the interests of public justice and preventing manifest injustice warranted the court invoking its extraordinary powers under Article 142 of the Constitution.

Decision

The Supreme Court allowed the appeal in part and upheld the 2011 Order issued by the state government, which granted the pay scale of ₹7,500-₹12,000 to the SDI/ABSA and DBSA officials, with effect from December 1, 2008. The court also directed that any excess payments made to the respondents should not be recovered, and that the arrears of pay or pension, if not already paid, should be paid within four months along with interest at 7% per annum.

The court's decision provides a final resolution to the long-standing pay scale dispute, ensuring that the education department officials in Uttar Pradesh receive the appropriate remuneration for their roles and responsibilities.
